Counting CMU's, that puts your 'scale figure' at 5'-4" tall. Looking at the water in the 2nd pict it looks like its about 24" below him, which puts it at 3'-4"? Maybe? My math sometimes doesn't work right.

let's give nacho a little credit please! he's actually 5'5" - remember the driveway is sloped. water in the garage was 39" when this was taken. that was the highest it got.
